Welcome to Consono. These Terms and Conditions ("Terms") govern your relationship with the consono.ai website and related services (the "Service") operated by Consono ("us", "we", or "our").

You further acknowledge and agree that Consono shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such websites or services.

We may terminate or suspend your account for a valid reason, including but not limited to a breach of these Terms. Where reasonably practicable, we will provide you with prior notice and an explanation of the grounds for termination, unless immediate termination is warranted due to the severity of the breach or legal requirements.
If you wish to terminate your account, you may do so at any time by contacting us at info@consono.ai or through the account settings functionality in the Service. Upon receipt of your request, we will close your account and delete your personal data in accordance with our Privacy Policy and the GDPR (see Section 11 below).
Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability, in each case only to the extent permitted by applicable law.
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by applicable Belgian and EU law, the Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

To the fullest extent permitted by applicable Belgian and EU law, Consono, its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, or consequential damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

If you qualify as a consumer under Belgian law, this indemnification clause shall only apply to the extent that the relevant claim arises from your wilful misconduct or gross negligence. This clause does not require you to indemnify Consono for claims arising from Consono's own acts or omissions.
These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.
Any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Belgium.
Consumer jurisdiction rights: If you are a consumer habitually resident in the European Economic Area, you may also bring proceedings in the courts of the Member State in which you are domiciled, in accordance with Article 18 of Regulation (EU) No 1215/2012 (Brussels I Recast). Nothing in these Terms shall deprive you of the protection afforded by the mandatory provisions of the law of your country of habitual residence.
In accordance with Regulation (EU) No 524/2013, the European Commission provides an Online Dispute Resolution (ODR) platform, which is available at: https://ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board unless required by applicable law. We reserve the right, at our sole discretion, to modify or replace these Terms. If a revision is material, we will provide at least thirty (30) days' notice prior to any new terms taking effect. Notice may be given by email to the address associated with your account or by a prominent notice on the Service.
Where changes affect the processing of your personal data, we will ensure that appropriate legal bases exist under the GDPR before the changes take effect, and where necessary, we will seek your explicit consent.
If you do not agree to the revised Terms, you may terminate your account in accordance with Section 9.2. Continued use of the Service after the effective date of the revised Terms constitutes acceptance of the new Terms.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely achieves the economic purpose of the invalid provision.
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Consono regarding the Service and supersede all prior agreements and understandings.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
These Terms are drafted in English. In the event of a conflict between the English version and any translation, the English version shall prevail, except where prohibited by applicable law.
